General Terms and Conditions of Sale – FE 26 Design

1. Conclusion of the Contract

The contract between FE 26 Design by Doublebackflip (hereinafter referred to as the "Owner") and the Customer shall be deemed concluded upon acceptance, even partial, of the order by the Owner. By placing an order on the website, the Customer declares to have reviewed all the instructions provided during the purchasing process and to fully accept these general terms and conditions.

2. Customer Obligations

If the Customer is a final consumer, once the online purchasing process is completed, they are required to print or save an electronic copy of these terms and conditions, in compliance with applicable legislation on distance selling.

3. Limitation of Liability

Any right of the Customer to damages or compensation is hereby excluded, as well as any contractual or non-contractual liability for direct or indirect damage to persons and/or property caused by the non-acceptance (even partial) of an order or by delays not directly attributable to the Owner.

4. Purchasing Procedure and Invoicing

For every accepted order, FE 26 Design issues an order confirmation sent via email. If the Customer requests an invoice, they must provide accurate details at the time of placing the order. No modifications to the invoice will be possible after its issuance.

5. Shipping and Delivery

  • Shipping Fees: Delivery charges are borne by the Customer and are clearly indicated prior to order confirmation.

  • Delivery Timeline: FE 26 Design cannot be held liable for any delays in order processing or delivery by third-party carriers.

  • Receiving Goods: Delivery is made at street level (piano strada). The Customer is required to inspect the integrity of the packaging upon arrival. Any external damage or discrepancies in the number of packages must be immediately disputed with the courier by adding the note "ACCEPTED UNDER RESERVATION FOR [REASON]" on the proof of delivery.

  • Reporting Issues: Any hidden defects (physical integrity of the products) must be reported within 2 business days of receipt by email to: info@fe26design.com

6. Storage and Failure to Collect

In the event of failure to collect the goods within 5 business days of storage at the courier’s warehouse, the order will be canceled. The Customer will be refunded the value of the products, minus the two-way shipping costs (original shipment and return) and any bank transaction fees incurred for processing the refund.

7. Intellectual Property and Copyright

All designs, drawings, graphic simulations, and intellectual creations developed by FE 26 Design remain the exclusive property of Doublebackflip. The Customer and third parties are strictly prohibited from reproducing or utilizing these designs for commercial purposes or for the physical execution of works through third-party suppliers without the prior written authorization of the Owner. The sale of the physical product does not transfer any economic exploitation rights of the original design.

8. Handcrafted Product Characteristics and Returns

  • Handmade Nature: The Customer acknowledges that the products sold are handcrafted. Consequently, slight irregularities, color variations, or minor shape nuances are not to be considered manufacturing defects, but rather intrinsic characteristics of artisanal craftsmanship that make each piece unique.

  • Right of Withdrawal and Return Costs: For non-customized products, the Customer has 14 days to exercise their right of withdrawal. In accordance with these terms, return shipping costs are entirely the responsibility of the buyer. The product must be returned intact and in its original packaging.

  • Exclusion of Withdrawal Right: The right of withdrawal is strictly excluded for all custom-made products or items clearly personalized at the Customer's request.

9. Maintenance and Liability (Coating and Corten Steel)

  • Limitation of Liability (Reseller Status): The Customer is informed that FE 26 Design acts as a reseller and not as a direct manufacturer of the individual components or coating processes.

  • Product Care: The use of harsh or abrasive chemical cleaning products is strictly forbidden. The use of such substances damages the finish and voids all warranties or support services.

  • Corten Steel Specifications: In the case of Corten steel products (even if treated or coated), the Customer accepts the risk of the natural evolution of the material. Despite protective treatments, Corten steel may release traces of oxidation (rust). The Customer is required to place the product in suitable areas where any potential rust discharge will not damage underlying surfaces.

  • Post-Return Liability Exclusion: Upon expiry of the 14-day return window, FE 26 Design by Doublebackflip assumes no legal liability nor can it be held liable for direct or indirect damage caused by coating defects, rust discharge, or deterioration due to weather conditions or improper maintenance. Acceptance of the product beyond the trial period releases the Owner from any obligation to provide compensation.
